Organ Donation
Organ Donation in England has transitioned to an "opt-out" system, commonly called Max and Keira's Law. This law assumes that all adults in England consent to organ donation upon death unless they opt out or fall into specific exempt categories:
-
Under 18 years old
-
Lack of mental capacity to understand or act on the decision
-
Temporary visitors or individuals not voluntarily residing in England
-
Residents of England for less than 12 months before their death
Respect for Beliefs and Culture
The law recognises the importance of each person’s faith, beliefs, and cultural considerations. Before any organ donation proceeds, medical professionals will discuss these aspects with the family. If you believe that your relative wanted to donate, inform the medical team early, as the timing can impact the feasibility of organ and tissue donation.
Organ Donation and the Coroner’s Involvement
In cases where the coroner is involved, permission may be required to proceed with the donation. This process is usually facilitated by the hospital’s transplant coordinator, working alongside the coroner to honour the deceased's wishes where possible.
