How Personal Loss Shaped Toucan Law: A Story of Empathy, Care, and the Importance of Estate Planning
My Story
The Importance of a Will: A Lesson Learned the Hard Way
In 2007, I experienced one of the most challenging times of my life. My mother passed away from cancer at the age of just 48. I was 27 years old, and in an instant, my world changed forever. On top of the overwhelming grief and heartache of losing her, I found myself in a position I had never anticipated: becoming the primary caregiver for my 11-year-old sister and taking on responsibilities that no one should have to face without guidance and support.
My mother, like many, hadn’t made a will. This meant that I was left to navigate the complex, confusing, and often overwhelming process of managing her estate and arranging her funeral without any clear instructions on what she would have wanted. All I wanted was to honour her memory and ensure that her wishes were respected, but the lack of a will made that incredibly difficult.
Thankfully, I had been working within the Wills and Probate profession since 1998 and so at least I understood the legal complexities and the importance of having a will.
However, even with nearly a decade of experience, nothing could have prepared me for the emotional and practical challenges of managing my mother’s estate.
Without a will, I had to make decisions that I wasn't prepared for. From planning her funeral to managing her assets and ensuring my sister's wellbeing, every step was fraught with uncertainty and fear of not getting it right. It was an agonising experience, trying to do what I thought my mum would have wanted, without having her guidance or a written document to direct me.
This personal loss and the challenges that followed taught me a profound lesson about the importance of estate planning. A will isn’t just a legal document; it’s a way to provide comfort and clarity to those left behind. It allows loved ones to focus on grieving and healing, rather than being burdened by complicated legal and financial decisions.
